BE SURE TO READ THE ENTIRE ADVERTISEMENT BEFORE CONTACTING THE AGENCY WITH BID RELATED QUESTIONS.

Performance and/or Design Requirements:

The Florida School for the Deaf and the Blind currently utilizes Achieve3000’s proprietary copyrighted service: Differential Literacy Solution educational online services and Technical and Data Support services. Estimated Dollar Amount shall not exceed $17,814.30. Intended source:

Justification for single source acquisition:

Achieve3000®, Inc. is the sole source for the Achieve3000 Literacy™, Achieve3000 Math™, Actively Learn, eScience3000®, and Smarty Ants® educational online services as well as the LevelSet™ assessment. Achieve3000 is the only provider of these services, each of which utilizes proprietary, patented technology (USPTO 8,714,986 and 9,652,993), copyrighted materials, trade secrets and source code that are, in various parts, either owned by Achieve3000 or licensed to Achieve3000. As a result, these services may be utilized only with the permission of Achieve3000.

This notice is neither a request for quote nor a solicitation of offers. This is the statutorily mandated seven business day advertisement of an intended single source procurement. The Agency believes this is a single source procurement; however, vendors that feel they can fulfill this procurement should provide information regarding their ability to supply the commodities or contractual services described within the seven business day advertising period by contacting the listed Primary Contact. A determination by the Agency not to complete this procurement based on responses to this notice is solely within the discretion of the Agency. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. Failure to file a protest within the time prescribed in §120.57(3), Florida Statutes, or failure to file a bond or other security within the time allowed for filing a bond, shall constitute a waiver of proceedings under Chapter 120, Florida Statutes.

Questions submitted to FSDB shall not constitute formal protest. Prospective vendors are requested to provide information regarding their ability to supply the commodities or contractual services described. If it is determined in writing by the agency, after reviewing any information received from prospective vendors, that the commodities or contractual services are available only from a single source, the agency shall provide notice of its intended decision to enter a single-source purchase contract in the manner specified in §120.57(3), FS.
