ADMINISTRATION COMMISSION

3. Consideration of Amendments to Rule 28-20.101, Comprehensive Plan - Monroe County (AC Case No. RUL-01-001) and Adoption of Proposed Rule Chapter 28-18, Land Planning Regulations for the Florida Keys Area of Critical State Concern - City of Marathon (AC Case No. RUL-01-002). Consideration of the Department of Community Affairs' recommendation to extend the Florida Keys Area of Critical State Concern Designation for an additional year.

On May 15, 2001, the Administration Commission considered the Department of Community Affairs' recommendation to extend the Florida Keys Area of Critical State Concern and the assessment of progress toward accomplishment of the work program objectives. The Commission accepted the Department's recommendation and continued the designation of the Florida Keys Area of Critical State Concern for one year. In addition, the Commission determined that substantial progress had been made toward work program objectives for Year Three by Monroe County, the City of Marathon, and the Village of Islamorada, and authorized rulemaking to restore rate of growth allocations for the City of Marathon and Monroe County. The Department was authorized to enter into rulemaking to revise Rule 28-20.100, Comprehensive Plan - Monroe County, and draft Rule 28-18, Land Planning Regulations for the Florida Keys Area of Critical State Concern - City of Marathon, due to its recent incorporation.

In June, 2001, initial revisions to Rule 28-20.100, Comprehensive Plan - Monroe County and proposed Rule 28-18, Land Planning Regulations for the Florida Keys Area of Critical State Concern - City of Marathon were published in the Florida Administrative Weekly. Both proposed rules were challenged. A period of negotiations occurred and additional revisions were published. In response, a challenge to Rule 28-18 was filed. In June, 2002, local governments and interested parties were brought together in an effort to resolve the issues of dispute. Consensus was reached and the Department of Community Affairs transmitted the "agreed to" final rules for consideration by the Administration Commission on August 28, 2002. Major changes as summarized by the Department address permit allocations, nutrient reduction credits, and revisions to the work program.

On August 30, 2002, the Department also submitted a recommendation to continue the Florida Keys Area of Critical State Concern designation for one more year.


Recommendation:

Authorize the Secretary to finalize rule adoption of amendments to Rule 28-20.101 and Rule Chapter 28-18, and extend the Florida Keys Area of Critical State Concern for an additional year.
