RECOMMEND APPROVAL

ITEM 2. Request permission to adopt a Final Order in the case of B.W. Marine, Inc. v. DOR in order to take Final Agency Action. The Proposed Final Order adopts, with modification, the Administrative Law Judge's Recommended Order sustaining an assessment for use tax in excess of $250,000.
