NOTICE: SURCHARGE REPEAL
Last year the Legislature and the Governor approved the repeal of the surcharge placed on alcoholic beverages sold for consumption on premises. The repeal takes effect on July 1, 2007. You will not have to file any more of the surcharge reports after the June 2007 report. The June reports are due on or before July 16, 2007.
Each licensee should complete an alcoholic beverage inventory form as of the “close of business” on June 30, 2007. We will include your inventory in the close-out audits we will conduct on all licensees beginning July 1, 2007. The close-out audits will allow us to make sure your reports and payments are correct.
Questions and Answers Regarding the Repeal of Surcharge:
1. Why is surcharge going away? On June 9, 2006, Governor Bush signed House Bill 7105 into law. This legislation’s primary focus was the repeal of the alcoholic beverage surcharge that had been in place since July 1990.
2. When is surcharge going away? The legislation calling for the repeal of the surcharge is effective on July 1, 2007. However, the Division of Alcoholic Beverages & Tobacco has until June 30, 2008 to complete final audits and make sure the proper taxes through June 30, 2007 were paid.
3. When do I complete my last surcharge report? The last surcharge report is due on or before Monday, July 16, 2007. The report will cover the month of June 2007.
4. Do I have to fill out an inventory form? Yes. Each licensee should complete a “Surcharge Inventory Certification” form and submit it to their local AB&T Auditing office. We will use the inventory information on this form to complete our final close-out audits of each business.
5. Will I be audited? Yes. AB&T will attempt to audit every retail beverage surcharge licensee between July 1, 2007 and June 30, 2008.
