Section 74-1. Travel on other than streets or highways.

(a) No person shall use a motor vehicle for travel on land other than streets or highways. As used in this section, the terms "motor vehicle" and "streets or highways" shall be as defined in F.S. ch. 316. Consent of the landowner, his agent or tenant may be used as a defense by any person charged under this section, but the burden of proof in such defense by competent evidence shall be upon the person so charged.

(b) Except as provided in subsection (c) of this section, no person shall use any vehicle for travel upon the dune area as defined in section 82-81. No person shall use any vehicle for travel upon the ocean beach, unless such vehicle is propelled by nonmotorized power.

(c) Subsection (b) of this section shall not apply to emergency vehicles of the police or fire department or to ambulances or to private towing vehicles, provided the police department is notified prior to the travel and the name of the person requesting towing assistance and the location of the vehicle to be towed is furnished.
