Section 110-246. Official zoning map--Adopted.
(a) The city is divided into zones or districts, as shown on the official zoning map which, together with all explanatory matter thereon, is adopted by reference and declared to be part of this chapter. The official zoning map shall be identified by the signature of the mayor, attested to by the city clerk and bearing the seal of the city under the following words: "This is to certify that this is the official zoning map referred to in section 110-246 of the code of Ordinances of the City of Cape Canaveral, Florida," together with the date of the adoption of the ordinance from which this chapter is derived.
(b) The official zoning map in effect at the time of passage of the ordinance from which this chapter is derived shall remain in effect and shall be reidentified as provided in subsection (a) of this section. If, in accordance with this chapter and state law, changes are made in district boundaries or other matter portrayed on the official zoning map, such changes shall be made on the official zoning map promptly after the amendment has been approved by the city council, together with an entry on the official zoning map as follows: "On (date), by official action of the city council, the following change(s) were made in the official zoning map: (brief description of nature of change)," which entry shall be signed by the mayor and attested by the city clerk. The amending ordinance shall provide that such changes or amendments shall not become effective until they have been duly entered upon the official zoning map or matter shown thereon except in conformity with the procedures set forth in this chapter.
(c) Any unauthorized change in the official zoning map of whatever kind by any person shall be considered a violation of this chapter and punishable as provided in section 1-15.
(d) Regardless of the existence of purported copies of the official zoning map which may from time to time be made or published, the official zoning map which shall be stored in city hall when not in use and readily available to the public shall be the final authority as to the zoning status of land and water areas, buildings and other structures in the city.
